A foreign operator established in an EEA country can obtain approval to operate a temporary driver business.
Approval to operate a temporary driver business cover commercial hiring out employed drivers for temporary:
Passenger transport for hire or reward,
- Freight transport for hire or reward,
- National freight transport for hire or reward in vans.
To obtain and maintain approval, the company must meet conditions related to drivers’ pay and working conditions.
The condition is that the company follows a wage level equivalent to the guiding collective agreements for drivers in Denmark when the driver is hired out for driving in Denmark with a Danish-registered motor vehicle or combination of vehicles.
There is no requirement for the company to be a member of an employer association, but the overall wage level for drivers must not differ significantly and clearly from the cost levels in the guiding collective agreements for drivers.
The company can document compliance with pay and working conditions by meeting one of the following:
- Be covered by a guiding collective agreement.
- Be covered by a nationwide collective agreement for drivers that does not differ significantly and clearly from the guiding collective agreements.
- Be covered by another collective agreement whose scope includes drivers, concluded by the most representative labor market parties in Denmark and applicable throughout Denmark.
- Follow a cost level that does not differ significantly and clearly from the guiding agreements.
